At a time when this so-called “Renaissance” (a slogan of the ruling Socialist Party of PM Edi Rama) has created deep confusion—leading to identity crises through the relativization of the very basic concepts of human nature with the “Gender Equality Law”—our amendment to the “Civil Status Law” aims to take a clear stance: to defend biological clarity and the foundation of the family. The amendment stipulates that “the gender of an individual is that determined at birth – male or female.” This seemingly simple sentence carries profound moral, scientific, and legal weight, as it preserves the foundations upon which society, the state, and human identity rest.
Truth Comes Before Any Ideology
This is not a political or religious issue, but a biological reality. A human being is born male or female — an immutable fact determined by nature through the XX and XY chromosomes. Denying this reality means denying the natural order and the logic of the social system. Feelings or ideological trends cannot change this foundation. Therefore, this legal principle is not an act of exclusion but of protection, ensuring that justice, education, medicine, and administration function on clear biological grounds.
The Risk of the “Woke Society” and Gender Confusion
In some countries where emotions have been placed above biology, an absurd reality has emerged: there are now over 70 invented gender identities. In some official documents, the words “mother” and “father” have disappeared, replaced by “parent 1” and “parent 2.” In schools, children are taught that gender is a matter of choice, not a natural fact. This is not freedom, but confusion. Albania must not follow this path. We have a duty to preserve the clarity of the new generation’s identity, education, and the biological foundation upon which every human relationship is built.
The Scientific and Legal Argument
In medicine, every treatment and analysis is based on biological sex. In law, every document or procedure begins from this fact. If the state allows registries to be based on “feelings,” it risks its own credibility. A clear legal definition guarantees the integrity of documents and the legal security of citizens, maintaining coherence between biology, identity, and the law.
In Defense of the Family and Moral Order
This definition aligns with the Family Code, which states that “marriage is a legal union between a man and a woman.” If gender becomes ambiguous in state records, this article loses its meaning. The change guarantees the stability of the Albanian family, the rights of children, and the moral order of society. The family, as the union of a man and a woman, is the foundation upon which every civilization stands.
The United Voice of Religious Communities
In this delicate debate, all Albanian religious communities — Muslim, Catholic, Orthodox, and Bektashi — have taken a united stance: “Man was created male and female according to God’s order, and this distinction is the foundation of human morality.” This spiritual and national unity proves that faith and reason walk together when it comes to the truth about humanity.
International Examples that Inspire
In the United States, in April 2025, President Donald Trump signed a federal decree defining gender in federal documents solely by sex at birth — a decision upheld by the Supreme Court. In Slovakia, Parliament passed a constitutional amendment recognizing only two genders, male and female. In most EU countries, including Italy, Hungary, Greece, and Croatia, as well as in Japan and Australia, civil law remains based on biological sex. With this change, Albania would stand alongside nations that defend identity and protect children from ideological confusion.
A Definition for Justice and Clarity
Without such a definition, confusion leads to direct consequences in medicine, sports, prisons, pensions, and administration. In sports, inequality arises when biological males compete in female categories; in prisons, safety problems emerge; in insurance, calculations become distorted. This principle safeguards the normal functioning of the state and public life.
Albania on the Side of Reason and Life
This legal proposal is not against anyone — it is in defense of everyone. It protects life, clarity, science, the family, and children. At a time when many countries bow to ideological pressures, Albania has the opportunity to demonstrate maturity and national dignity. Enshrining this truth in law would be a “yes” to life, to reason, and to the Albanian family — a law that does not divide but protects, restoring dignity and clarity to society.
